Fifth child dies in US custody after being detained at the border

A 16-year old Guatemalan boy died in US custody Monday, May 20th after being detained at the border a week earlier.

The agency says the teenager was apprehended May 13, 2019 and was found unresponsive Monday morning, May 20th during a welfare check. Why this minor was being held in these conditions when he should have been transferred after the 3-day deadline remains unanswered.

Section 4.1 of the CBP’s National Standards on Transport, Escort, Detention and Search handbook clearly outlines the Duration of Detention standards stating, “Detainees should not be held longer than 72 hours.”

Minors, due to their vulnerable age, require additional care and oversight when in the custody of CBP and it is sickening to learn that this is the fifth migrant child to die is US custody since December.

More than ever we have to hold the CBP and other Federal entities accountable for their lack of compliance with the court orders stemming from the Flores settlement that are meant to protect and promote the rights of immigrants.

CHRCL is currently organizing a delegation of volunteers to promptly visit the Rio Grande Valley in the upcoming weeks to conduct interviews with migrants being detained in detention centers such as these whose declarations will be critical in making sure the Federal government is held responsible for any violations with respect to the Flores agreement.
